Products Terms & Conditions

1. General

1.1. The purchase of Smart QR, Smart QR Pro, Smart Printer, Smart Store, and T9 (Credit Card Terminal) and/or other payment instrument services provided by BFSB (hereinafter collectively referred to as “Products”) and associated data plan(s) by Bayarlah Merchants is offered by Beez Fintech Sdn. Bhd. (“BFSB”).

1.2. All Products are intended for use with Bayarlah platform and services only.

1.3. The user / Merchant hereby acknowledges and agrees that it shall also be bound by the Merchant’s Terms and Conditions, as amended from time to time, which are hereby incorporated by reference and shall form an integral part of these Terms and Conditions. Capitalised terms used in this Term and Conditions shall have the meanings ascribed to them in the Merchant’s Terms and Conditions, unless the context otherwise requires
 

2. Eligibility

2.1. Existing Merchant of Bayarlah.

2.2. The Merchant that wants to purchase the Device is required to apply and register as Bayarlah’s Merchants.

 

3. Payment

3.1. Payment for the Products and/or data plan must be made through online payment or QR payment and collected by Beez Fintech Sdn. Bhd.

3.2. Any cash payment that is paid to third parties, including payments that are represented to be towards or on behalf of BFSB will not be recognized by BFSB.

3.3. After the payment of the Products and/or data plan paid by the Merchants, the Products shall become the Merchant’s property.

3.4. The Products are not returnable upon acceptance of the Products and any collected payment towards the Product shall not be refundable unless provided in this terms and conditions.

3.5. Refund of payment, at the sole discretion of BFSB, may only be refundable on the situations below:

3.5.1. If Merchant is rejected or is unsuccessfully onboarded by BFSB; or

3.5.2. If Products are deemed defective after thorough investigation and approval from BFSB.

 

3.6. The Merchant shall be responsible for all courier and shipping fees associated with the delivery of Products, except in cases where the Products are defective. In any case of defective items that are caused or attributable by BFSB, any courier and shipping costs to return the same shall be borne by BFSB.

 

3.7. Subject to the investigation findings of any defective Products, approved refunds shall be scheduled on the 15th, 30th or 31st of such month. Eg: a refund request is made on the 5th of the month and the investigation is concluded on the 8th of the month, the payment of refund will be issued to the Merchant on the 15th of the same month.

 

4. Waiting period​

4.1. Unless mentioned otherwise, all Products are preordered items.

4.2. After the payment of the Products is paid by the Merchants, a minimum fourteen (14) days waiting period is applicable to Merchants for waiting BFSB to deliver the Products to the Merchant.

 

 

5. Product Warranty

IMPORTANT: BY USING PRODUCTS BY BFSB, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE BFSB ONE (1) YEAR WARRANTY (“WARRANTY”) POLICY AS SET OUT BELOW.

5.1. The warranty of the Products will be thirteen (13) months (“Warranty Period”).

5.2. The Warranty Period for the Products shall commence from the date of activation in the system.

5.3. The warranty of the Products are only applicable on the system and/or interior part of the Products.

5.4. Upon receipt of the Products that is covered during the Warranty Period by BFSB, BFSB shall:

5.4.1. Send the Products for inspection and replace the parts to fulfill its functional requirements; or

5.4.2. Replace the Products with a replacement product of the same model or product that has the same or substantially similar features as the original product (“Replacement Products”). If the Replacement Products have additional features that is an improvement of the original Products, the Merchant shall reimburse BFSB for the additional cost of the Replacement Products.

5.4.3. The shipping costs for the repaired or Replacement Products under the Warranty Period, including inbound and outbound shipments shall be borne by BFSB for the first shipment only.

5.4.4. Any subsequent shipping costs including but not limited to the cost of delivery of the repaired Products or Replacement Products by BFSB shall be borne by the Merchants.

5.4.5. Products that have been repaired or replaced by Replacement Products shall be delivered by BFSB.

5.5. All Warranty claims shall be processed within seven (7) working days from the date of receipt of a report. However, subsequent replacement with a new product or repair shall operate on a first-come-first-serve basis and is subject to the availability of parts and technical evaluation.

5.6. BFSB shall not be liable for any damages including but not limited to loss of use, loss of revenue, loss of actual or anticipated profits, loss of business, loss of opportunity during the ineffective use of the Product and reparation.

5.7. This Warranty does not cover any of the followings:

5.7.1. Any damages, dents, defacement, scratches, stains, or marks however caused external of the Products;

5.7.2. Any damages, defects, malfunctions or non-functioning to or in the Products howsoever arising from, caused by or incidental to any external cause (including accidents, fire, lighting and Act of God or any other such like matters);

5.7.3. Any damages and failures arising from any abuse and/or negligence by Merchants or third parties;

5.7.4. Any damages and failures arising from the services (including but not limited to any modification, disassembling or repair) in relation to the Products given by any third-party provider and not BFSB; and

5.7.5. Upon occurrence of any of the following events, BFSB at its sole discretion, immediately terminate the Warranty and treat the Warranty as null and void. Upon such termination, BFSB will no longer be liable or responsible to carry out any reparation or replacement of the Products even if it is still within the Warranty Period.

5.8. BFSB will not be responsible for replacing the Products or any part thereof that is lost, stolen, or damaged.

 

6. Product Specific Terms

6.1. Smart QR & Smart QR Pro​

6.1.1. The product is provided with a one (1) year warranty. The SIM card (which shall be purchased separately) may be deactivated if it remains unused for a continuous period of sixty (60) days. Reactivation of a deactivated SIM card which has been deactivated for more than one (1) year shall require the purchase of a replacement SIM card at a fee of Ringgit Malaysia Ninety-Six (RM96.00). Conversely, reactivation of a SIM card that has been deactivated for less than one (1) year will be subject to a fee of Ringgit Malaysia Ten (RM10.00). All reactivation and usage are subject to the applicable general terms and eligibility requirements.

6.2. T9 (Credit Card)

6.2.1. The product is supplied with a one (1) year warranty and an accompanying SIM card. The SIM card may be deactivated if it remains unused for a period of sixty (60) consecutive days. Reactivation of a deactivated SIM card which has been deactivated for more than one (1) year shall require the purchase of a replacement SIM card at a fee of Ringgit Malaysia Ninety-Six (RM96.00). Conversely, reactivation of a SIM card that has been deactivated for less than one (1) year will be subject to a fee of Ringgit Malaysia Ten (RM10.00). All usage and reactivation are subject to applicable general terms and eligibility requirements.

6.3. Smart Printer​

6.3.1 The Smart Printer service includes an accompanying SIM card. The SIM card may be deactivated if it remains unused for a period of sixty (60) consecutive days. Reactivation of a deactivated SIM card which has been deactivated for more than one (1) year shall require the purchase of a replacement SIM card at a fee of Ringgit Malaysia Ninety-Six (RM96.00). Conversely, reactivation of a SIM card that has been deactivated for less than one (1) year will be subject to a fee of Ringgit Malaysia Ten (RM10.00).  All usage and reactivation are subject to applicable general terms and eligibility requirements.

6.4. Smart Store

6.4.1 The service is provided on a Software-as-a-Service (SaaS) basis under the Lite Plan and the Full Plan (which shall only be available for F&B Merchants only) and shall be available exclusively to Merchants who have been successfully onboarded through the Bayarlah payment channel. A one-time licence fee shall be payable, which shall include the provision of a Smart Printer, installation services, and menu configuration. In the event that the total monthly transaction volume fails to achieve a minimum threshold of Ringgit Malaysia Five Thousand (RM5,000.00) within thirty (30) days, the service shall be automatically and temporarily suspended. During such suspension, the Smart Store shall not be entitled to access or use the service unless and until the relevant account is reactivated through the Bayarlah payment channel.

6.5. Split Payment

6.5.1. This feature is made available through the Bayarlah application and may only be accessed and used by duly registered Bayarlah users and Merchants in accordance with these Terms and Conditions. The Split Payment feature constitutes a business-to-business payment service that enables BFSB to allocate and distribute funds arising from a single transaction among multiple designated parties, in such proportions and to such accounts as may be specified through the Bayarlah platform.

6.5.2. Unless otherwise expressly agreed or specified, all funds shall be settled automatically in accordance with the applicable standard settlement timelines following successful reconciliation. Where applicable, BFSB may offer or apply a manual release mechanism, pursuant to which funds may be temporarily withheld and released at a later time, including (without limitation) upon confirmation of the delivery of goods, completion of services, or fulfilment of any agreed conditions.

6.5.3. In the event of any refund, chargeback, dispute, reversal, adjustment, cancellation, or other similar event affecting a transaction, BFSB reserves the right, without prior notice, to reverse, rebalance, net off, claw back, or otherwise adjust any amounts previously split or settled, to the extent necessary to reflect such event or to comply with applicable rules, card scheme requirements, contractual obligations, or regulatory requirements.

6.5.4. By electing to enable or use the Split Payment feature, each Merchant and user irrevocably and unconditionally authorises and consents to BFSB deducting, withholding, reallocating, or settling any amounts from monies payable or credited to such merchant or user in accordance with the split instructions, settlement mechanics, and adjustment rights described herein. Such authorisation shall apply automatically and without further notice, consent, or approval, and shall remain valid for so long as the Split Payment feature is enabled or any related obligations remain outstanding.

6.5.5. Each merchant and user further acknowledges and agrees that BFSB acts solely on the basis of the instructions and parameters provided through the Bayarlah platform, and shall not be responsible or liable for any loss, shortfall, delay, or dispute arising from or in connection with the agreed split arrangements, save in cases of fraud, wilful misconduct, or gross negligence by BFSB.

6.6. E – Invoice

6.6.1. Merchant hereby acknowledges and agrees that all e-invoices generated or requested through the Bayarlah application shall be classified under the “Others” category, with no stock keeping unit (SKU) items listed. The Merchant further acknowledges that credit note functionality is not supported by this feature, and that comprehensive e-invoice services, including without limitation SKU itemisation and credit note issuance, are available exclusively through the Smart Store platform. The Merchant represents and warrants that it maintains a valid business entity and has successfully completed the requisite registration process via the Bayarlah application.

7. Additional Features & Requirements

7.1. The Products are provided for the Merchant’s business purposes only and not to be resell or transfer to any third party without the written approval from BFSB.

7.2. The Products can only be used/function through the Bayarlah platform.

7.3. The data plan (SIM cards) cannot be used for other purposes except for purposes agreed under this Term and Conditions or the Merchant terms and Conditions.

7.4. BFSB shall not be responsible for any unauthorised use of other data plan (SIM cards) by the Merchants, including any technical problems/ failures of troubleshooting of the Products arising therefrom.

7.5. BFSB has the right to suspend, disconnect or terminate the data plan service if the Merchant does not meet the agreed-upon obligations.

7.6. All Merchants and users of Bayarlah are subjected to the BFSB’s Bayarlah Products Terms & Conditions, Privacy Policy and any other terms and conditions that BFSB might imposed for its Merchants including any subsequent revision, amendment, or improvement deemed necessary by BFSB.

7.7. The prices of the Products shall be set out in Appendix A or otherwise made available through the Bayarlah platform, and BFSB may revise such prices from time to time by updating the applicable listing on the platform, which shall take effect upon publication.
